My son sold his car to a friend for £1600, but after a month he still hadn’t received the money so he took the car back using a breakdown truck however the friend won’t hand over the keys, saying he wants paying for four new tyres. My son says it would have cost him more than that to hire a car for a month!
Strictly speaking your son wasn’t legally entitled to take his car back without warning but if the matter came before the small claims court he would probably be awarded his £1600, the value of the tyres would be set against the friends use of the vehicle for a month and they would probably cancel each other out. It would be much better (and cheaper) to sort the dispute out amicably if possible.
