Areas of Law / Personal Injury

A car ran into the back of mine six months ago. I was paid out for the damage to my car, but put in for a whiplash injury. However I’d already been seeing the doctor about a neck pain, and the specialist I saw refuses to say categorically that I’ve sustained a new injury. I’m being sent for a second opinion; do I have to sign to say I agree with the first report?

No, but if there’s some doubt about whether you sustained an injury in the crash it will obviously affect your case for compensation. Under Civil Procedure rules the first report will have to be disclosed, and you will have to pay for the second yourself. Hopefully it will be more conclusive.
