We took our employers to the minimum wage tribunal and won our case. The firm appealed against the decision in January, and we’re now trying to find out if a date has been set for the appeal, but they keep telling us they don’t know. Is there a time limit for this type of thing?
No. Once an appeal has been lodged the matter becomes part of the judicial process and there is no set time in which the appeal must be heard. Keep in touch with HMRC. If it’s decided that an underpayment has been made you will not only be entitled to the minimum wage in future but to any back pay owing. If employers fail to comply with an enforcement notice they can be fined double the minimum wage for every worker underpaid for every day they were underpaid.
