Areas of Law / Wills and Probate

The executors administering my father’s will have taken over four years to distribute his estate because of arguments over certain possessions. The solicitors acting for the executors have insisted I sign acceptance of their final account before making their last payment to me; are they entitled to withhold this money when I believe they’ve still got it wrong?

If these issues need to be referred to the court the executors will have to hold back money to cover their costs. All claims must be investigated and dealt with before the estate is wound up, since both the executors and the solicitors can be held liable if the estate is administered incorrectly. It’s in your interest to resolve family squabbles, because legal fees which will arise from going to court will probably be paid from the estate, thereby reducing your inheritance.
