Areas of Law / Crime

If the police come to your house with a search warrant stipulating a certain number of items, can they just take what’s on the list, or can they take anything that takes their fancy?

If the police are carrying out a lawful search generally speaking they can take anything they find which is material evidence or the result of a crime. This can be evidence of any crime, not just the crime for which the search warrant was granted or for which someone is under arrest. If property has been seized which the police had no clear authority to take, the owner can take action to force them to return it. If someone is later charged and appears before a magistrates’ court an application can be made for the return of property seized.
