I live on the first floor of a council flat. The man in the flat below me (his family own the flat) is a heavy smoker and uses cannabis, and the smoke reaches me every time he and his friends light up. The council and the police say there is nothing they can do. However since smoking is now banned in pubs and vehicles I wonder if this is true?
There is nothing that you can do about your neighbour and his visitors’ smoking. It is part and parcel of having to live in close proximity to others. Smoking cannabis of course is illegal. However if the police are not prepared to take action then, unless there is a clause in your neighbour’s tenancy agreement preventing them smoking (and that is unlikely), there is nothing you can do other than apply to be relocated by the council.
