Areas of Law / Property

I live in a small terrace of four houses with the drainage facilities connected to the end house where the cesspool is situated. The owner of the end house has died and the property is for sale. I have been given notice that I will no longer have use of this facility, which I have been connected to for about 25 years. Do I have any right to challenge this?

Check your title deeds (or ask your solicitor to check) to see if they give you any right to connect to the end house’s cesspool.  A legal right can also arise by long usage, but not if you only had your neighbour’s permission to connect to his cesspool. I suggest you also contact the water board to see if alternative arrangements can be made for the longer term, and seek advice from a lawyer.
