I have just found out that my wife has taken out a loan of £5000 secured on our property, which is jointly owned. This has all been done through the post, and she faked my signature. How do I stand?
If the property is in joint names as beneficial joint tenants both signatures will be required on the loan document. If one of the signatures is not genuine then on the face of it the loan is not secure and the lenders will want their money back at once. In practice your wife would most likely have to find the money to repay the loan from elsewhere, which would probably involve you, assuming you’re prepared to stand by her. If you object strongly to the loan you could inform the lenders, but there could be serious consequences for your marriage.
