Areas of Law / Property

The deeds to our house have been mislaid. Is there a record or register of property deeds? If not, what course should we take to prove that our house belongs to us?

You need to check whether your house is registered at the Land Registry; if you bought it within the last 40 years it probably will be, but you can check this online, or ask your solicitor to do so. If it’s not registered, then, if all else fails you may have to swear a statutory declaration explaining that the title deeds have been lost and providing evidence of your ownership. The Land Registry would then decide on your ownership of the property. If you have a mortgage your title deeds may be in the possession of your lender.
