Wills and Probate Questions

I was divorcing my husband when he died. We owned a house together, but it emerged that my solicitor had sent my husband a notice dividing ownership of the house, which he had duly signed. Does the house now belong to me?

As a named beneficiary in a will, do I have a legal right to see the accounts showing how the estate was wound up? The estate is supposed to be divided into three equal parts, but the other two beneficiaries, the executor and a relative of his, are keeping me in the dark. Will I be entitled to see things such as bank statements, life policies and property sale receipts?

Two months ago my wife and I each received £250 left to us in a cousin’s will. However the solicitor who sent us the money has now asked for it back, having discovered a codicil cancelling the legacy. We’ve spent the cash: do we have to pay it back?

My father died three years ago leaving just over £50,000. My sister and I, who are his joint executors, are to receive half each after a bequest of £5,000 is made to a half-sister. We have had no contact with her for over 40 years and despite extensive searches we cannot track her down. Is there any time limit in law for us to keep this money set aside?

My husband had the house put into his name only because at the time I wasn’t old enough to sign the legal documents. As we’re getting older I wondered what my position would be if anything happened to my husband. Would I still be able to keep the house?

My sister-in-law died in a nursing home in London last year. Her house had been sold before she died, and the will is fairly straightforward, so we are concerned at the length of time it is taking to wind up her estate. My wife and I are joint executors together with a solicitor in London.

My wife and I have separate bank accounts. I have made a will leaving everything to her, but she hasn’t made a will. Would I be entitled to what was in her bank account if she died first?

My mother and my aunt are about to obtain letters of administration for the estate of my cousin, who died recently. However my uncle had an enduring power of attorney to deal with her affairs. Will my mother succeed if she applies for an injunction to prevent him taking any part in the administration?

An elderly relative wants to leave me some money in her will but she is adamant that she would not leave me anything if it meant my wife would have a claim on the money should we divorce. She says this is the law: is this correct, and is there any way round it?
