If you have been arrested for drink driving and you know that you have not drunk alcohol, do you still have to give a breath test?
Provided that the police officer who arrested you had reasonable cause to believe that you may have been the driver of the vehicle then he can require you to give a breath sample – even if you were not actually the driver, never mind that you hadn’t consumed alcohol! If you refuse or fail to give a sample then you can be prosecuted for this, and if convicted you may be disqualified for a minimum period of 12 months.
