We received a six-month shorthold tenancy agreement from our landlord last September, it’’s now three months overdue. Will this be a “rolling” tenancy, or do we have to contact our landlord in order to renew it?

If your landlord doesn’’t give you notice, or you don’’t sign a new tenancy agreement, your tenancy automatically becomes a periodic assured shorthold tenancy, also known as a rolling agreement. Periodic tenancies continue from month to month (if that’s how your rent is paid) and a tenant can usually leave on one month’s notice. The landlord has to give you two clear months from the rent payment date. Asking for a new tenancy agreement will give you more security (although a longer commitment) but you may be asked to pay a renewal fee.
