Areas of Law / Property

We have a number of sheds which divide our property from next door. Our neighbours have attached hanging baskets and a bird box to “their” side of one of the sheds, and we are worried that it might cause damp to come through. Are they within their rights to do this?

If your sheds are permanent structures straddling the boundary then the boundary walls would probably be regarded as “party fence walls”. Guidance concerning these suggests that neighbours can drill into them as long as the overall structure isn’t weakened. If the sheds aren’t on the boundary your neighbours shouldn’t be attaching anything to your property, and you can ask them to remove the offending items if necessary. However thousands of people do exactly what you’ve described with no adverse effects.
