Areas of Law / Property

Three years ago we moved into a detached house with a driveway down one side and a path down the other. The current owners of the house next door have used the path for ten years, and the previous owners did so before them. We don’t mind the neighbours using the path but it has been suggested to us that we could eventually lose the land if this continues.

Your neighbours could acquire a right to use the path if they and their predecessors have done so unchallenged for 20 years or more. You should take action to prevent this happening: a letter to your neighbours (keep a copy) asserting your ownership of the land and giving them permission to cross it should be enough to head off any potential claim from the neighbouring property.
