Areas of Law / General Legal Advice

While taking a car on a test drive from a showroom I had an accident and the car was damaged. I don’t currently own a car so I don’t have insurance, and the showroom is threatening to sue if I don’t pay for the damage. Shouldn’t the dealer be insured?

If the accident was caused by someone else the garage should be able to recover its losses from that person or their insurers. If the accident was your fault then on the face of it you may be liable to pay for the damage. However you could defend the case on the basis that it was reasonable for you to assume that you were covered by a blanket policy taken out by the dealer. If the dealer didn’t check that you were insured before handing you the keys I suggest you see a solicitor.
