Areas of Law / Child Law

My step-daughter left her baby with us for a month while she went abroad to patch things up with her fiancé. In the event she stayed away ten months. We felt the baby had been dumped with us so we are considering asking for an order for the child to live with us. What are our chances of success?

The court will do what it feels is best for the baby, but it’s true to say that the younger the child, the more reluctant the court will be to separate the child from the mother. On the other hand, it sounds as though the baby has spent most of its short life with you. You will probably be asked to attempt to reach an agreement with the mother about what’s best for the child through mediation. Ask your solicitor about this.
