Areas of Law / Divorce and Family

My partner left me four months ago, taking our six-year-old daughter with her. Our house is in joint names, and has equity of just £10,000. I have offered her £4,000 in settlement of any claim she has against the property but she won’t discuss it.

Your partner could ask the court to let her use some, or all, of your share in the property in order to provide a home for your daughter. This money would be returned to you when your daughter reached 18. If you cannot reach agreement over the division of the equity your partner may consider asking the court to allow her to remain in the property. You need detailed advice from a solicitor. As things stand your partner will be entitled to half the equity in the property whenever it comes to be sold.
