Areas of Law / Employment

Our firm has just been taken over, and our jobs were transferred under a TUPE agreement. How long is the TUPE agreement valid for?

Such transfers are permanent, and not for a specified period of time. It means your terms and conditions – working hours, pay, holiday entitlement and so on – remain the same, even though you have changed employer. What’s more, your service record transfers too; so if you worked for your previous employer for ten years but have only worked for the new firm for 12 months, you would be reckoned to have worked for the new firm for 11 years if (for example) it became necessary to work out a redundancy package for you.
