Areas of Law / Property

My neighbour treats my fence as her own, piling soil against it and I fear it will rot away. Last year I had to see a solicitor because her shrubs were growing up to a metre into my garden. Can I force her to remove the soil?

From a legal point of view your neighbour will be responsible for making good any damage she causes to your fence, but it might be difficult to prove that her actions caused it to rot. I’d be reluctant to get involved in a legal battle over this. Neighbours who take care of their gardens are a wonderful thing. Bear in mind the number of people who’ve contacted us about neighbours who keep scrap vehicles and building materials in their gardens.
