Areas of Law / Wills and Probate

My elderly mother’s doctor thinks she may be suffering from dementia. She gets confused and upset, and recently she told me she had cut me out of her will. I don’t mind this so much, but my mother has arranged her funeral and my sister has put herself down as next of kin. As the eldest child, do I have any rights?

Your rights as regards the funeral arrangements will depend on what’s in your mother’s will. If the will doesn’t mention the funeral, you and your sister will have an equal say in organising it. Many people with an elderly parent will sympathise with your predicament. If your mother has cut you out of her will recently it’s possible you could challenge the alteration bearing in mind the doctor’s opinion of her mental health.
