When an accident like yours happens it’s important to gather the evidence quickly before it disappears but assuming you and your solicitors were on the ball I’m afraid theyre probably correct. The rule-of-thumb in these cases is that if the flagstone was raised less than an inch the council are unlikely to be liable. The courts have said that it is unreasonable to expect a council to keep a pavement completely smooth.
