Areas of Law / Employment

I worked for a company for five years and was made redundant last month. But within a few days they asked me back. I refused, but they’re now saying they won’t give me my redundancy pay. What’s my legal position?

As long as you were told quite clearly that you were being made redundant – not that redundancy was on the cards at some date in the future – your contract was terminated and you would be entitled to refuse their offer. It will certainly clarify matters if you were issued with a redundancy notice. Whether your refusal in this case was reasonable will depend on the detail, and you should seek advice from a solicitor. If your refusal was reasonable, you should claim the payment from your employer in writing, or refer the question to an employment tribunal within six months.
