I was employed by a nursery for 12 weeks before being dismissed for what was in effect a personality clash with my supervisor. I took some days off when I was ill and had a written warning for my “attitude”, but can they just treat you like that?
Yes, I’m afraid they can. Until you’ve worked for an employer continuously for two years you have no right to claim that your dismissal was unfair and that you should receive compensation. The only exception is where the reason for the dismissal was race, sex, age or disability discrimination, or related to trade union activity or for raising health and safety issues. Subject to the terms of your contract an employer need only give you a week’s notice, or pay in lieu of notice, if he or she wants you to leave for any other reason.
