Areas of Law / Employment

I was off sick for two weeks, during which time a director of the company called to say I was being made redundant. I’m told you cannot be made redundant while you are off sick. Is this true?

No. The question is: was your redundancy genuine and fair? If someone is now doing your job it was not a genuine redundancy. You would have a claim for unfair dismissal if you were dismissed while you were off sick and your employer took no steps to determine the nature of your illness, how long it might last and when you might be able to return to work. Similarly you could claim that you were unfairly selected for redundancy if you felt the reason was that you were absent from work. If in doubt see a solicitor as soon as possible.
