Areas of Law / Divorce and Family

I have two children. Their father hasn’t seen them for four years and even the Child Maintenance Service can’t track him down. I’ve remarried and my new husband would like to adopt them. Is there any way this can be done under the circumstances?

If your children are young your new husband may eventually be successful in being able to adopt them. The court will try to do what is best for the children, but it will want to know what efforts have been made to trace the natural father. The CMS has very wide powers to track down absent parents via the Inland Revenue and the like, so it would be advisable to get hold of a letter confirming what efforts have been made. I think you will need a solicitor’s help.
