I have been employed for the last five years by a small firm with fewer than a dozen employees. Just over 12 months ago I became too ill to work and went on statutory sick pay, followed by Employment and Support Allowance, and all this time I’ve never received any assistance from the company. I have now had heart surgery and intend to return to work when I’m well enough. Do they have to take me back?
It’s possible your illness would be regarded as a disability under the Equality Act 2010, in which case the firm will have a duty to try to find you lighter duties. You should contact them as soon as possible, giving them a date when you can return.
