I declared myself bankrupt two years ago when my debts reached £20,000. I have now been discharged, but although I made regular payments to the trustee they are now asking about my pension. Is this also at risk?

Under the Welfare Reform and Pensions Act 1999 approved pension arrangements do not form part of a bankrupt’s estate. The Official Receiver therefore has no claim over the majority of pensions or any accruing benefits. If necessary you should seek professional help to see whether your pension is excluded or not. If you are considered to have made excessive payments into your pension scheme at the expense of your creditors, there is a procedure under the Act to seek recovery of overpayments.
