Areas of Law / Employment

I am an agency driver. Should we be entitled to the same holidays as full-time employees?

You are employed by the agency, not the firm you are driving for, so your contract of employment is likely to be substantially different to that of the firm’s full-time employees. However workers in the transport industry are included in the provisions of the Working Time Regulations, which give most workers a statutory 5.6 weeks’ paid holiday (including public holidays) a year. Beyond that your holiday entitlement will depend on your employment contract or custom and practice within the agency or transport industry as a whole.
