I accepted an out-of-court settlement on the basis that my solicitor’s fees were paid by the other party. I was informed that the other party was holding out. But now my solicitor doesn’t return my ‘phone calls or answer my letters, so I can’t find out what’s going on. Was I right to insist on the other side paying my costs?
If the defendant won’t accept your terms the matter may have to go before a court, where a judge would decide what compensation you are to receive and whether the other party should pay your legal costs. This will obviously involve further expense and you should take your solicitor’s advice. Find out who at the solicitor’s firm has been designated, under Law Society rules, to deal with complaints, and write to this person about your solicitor’s silence.
