Areas of Law / Property

When our house was built 40 years ago our deeds stated that we were responsible for making up one half of the width of the road, with the council being responsible for the other half. The road would then be adopted by the council. The council is now planning to widen the road, destroying grass verges and uprooting well-established trees. Do we have any say in what can be done?

It’s just possible that you own half of the road adjacent to your property, although it’s more likely that the council now owns the road and verges. Check your deeds. The agreement you refer to was probably reached by the original developer and the council. In any event the council will have to apply for planning permission to widen the road, so you and your neighbours should make your views known.
