Areas of Law / Property

We have cleared a ditch and put drainage in to take rainwater from our property, but it’s not going anywhere because our neighbour’s ditch is blocked. He hasn’t refused to clear it, but says he’ll dig it out by hand. We reckon this could take him two years! Is there any way of making him do it more quickly?

Assuming your deeds give you the right to discharge water on to your neighbour’s land you may be able to get a court order requiring your neighbour to take action. But it may be quicker, cheaper and more neighbourly to offer to do the work yourselves if you have a mechanical digger to hand. I can’t give you further advice without seeing the relevant covenant in your title deeds.
