Property Questions

I jointly own a property, but my ex-partner was made bankrupt and a bankruptcy order was placed on the house a year ago. Will this order be removed if he is now discharged, or will they still be entitled to my ex-partner’s share when the house is sold?

I bought a new house just over 12 months ago. Structural cracks have started to appear in the walls and the foundations are visibly moving. The builders have brought in a consultancy firm, which is monitoring the movement. What’s my position on this?

They’ve built some new houses on the other side of the six-foot fence which runs for 50 yards down the side of our garden. Now the developers have put up their own fence, which is about six inches from our own, and means we can’t get to the other side to maintain it.

We live in a block of four flats. Our tenancy agreements say we’re obliged to take out insurance, but when a fire damaged the block recently it emerged that the tenants of the flat where the fire started weren’t insured. Who can we claim compensation from in the circumstances?

I was interested in buying a leasehold property, but I asked the estate agent whether I could also buy the freehold through the owners signing the necessary forms. After a long wait they told me this was not possible and couldn’t tell me what it would cost.

I have lived in this house for 35 years without paying rent. When my father died some years ago I discovered my sister had made him draw up a deed of conveyance signing the property over to her son. What’s the position with my home?

There’s a footpath running across my land. I was wondering, if someone suffered an injury while walking on this public footpath, who would be responsible?

I bought my own house three years ago. I was considering asking my girlfriend to move in with me, but I’m told me that after six months she would be classed as my common law wife. Is this true, and would she therefore be entitled to half the house if we were to split up?

I have owned my home for more than 30 years, but after being made redundant last year I decided to rent out my property and move in with my girlfriend. If I sell my home next year, would I be liable to pay Capital Gains Tax?
