Property Questions

My mother’s fence was fastened to the outbuildings at the bottom of her garden. When the fence fell down she ordered a replacement, but the neighbour who owns the outbuildings asked our builder to stop work because he was planning to demolish them shortly and reduce the height of the wall. We asked the neighbour to pay for the cost of taking the fence down again, but our builder says it’s not worth falling out over.

I live in the middle house of three in a terraced row. As a result my guttering doesn’’t have a downpipe, but my neighbours want me to contribute to the cost of replacing their rainwater systems since they’re used by water coming off my roof. Do I have to chip in?

When a council employee was marking the pavement in front of our house for repairs recently he told us that half the pavement was our responsibility and we would have to chip in. Is this true, and if so, would we be liable if someone tripped and broke their leg on it?

We want to put up a fence between our garden and next door’s. I understand that the “good” side of the fence has to face the neighbouring property if it’’s on the boundary line, but does this law still apply if the fence is completely on our side and doesn’’t touch the boundary?

I am buying 20 acres of agricultural land and a search has turned up a covenant placed on it by the Church Commissioners. We don’’t know what it relates to, and I have been advised to take out an indemnity policy to guard against future problems. Should we search further and risk uncovering bad news or let sleeping dogs lie?

We finished paying for our house this year, since then I’’ve written several times to the building society asking them to return our title deeds. They can’’t seem to find them. How will we ever be able to sell our house?

I am a pensioner who gets someone in to mow my lawn and generally tidy up my garden. Is it true that if someone does this on a regular basis they can claim the land after a number of years?

Our annual ground rent demand usually arrives in November, but last year we didn’’t receive the bill. The firm of solicitors that normally deals with it have told us to wait, but we are getting worried because we want to put the house up for sale soon. Should we send a cheque for the amount we owe?

I have bought a house but I haven’’t received a “property information form”. Should this have been shown to me by my solicitors?
