General Legal Advice Questions

The bank tells me that if by mistake they pay out on cheques that haven’’t been cashed after six months I will still be liable. Can this be correct? Am I legally bound to replace a cheque after it becomes invalid?

In between my house and next door there’’s a small patch of land. The owner has been refused planning permission to build on it following objections from other residents. Now the land is neglected and attracts fly-tippers, but the owner doesn’’t want to know, instead he wants £15,000 for an oversized garden. Is there anything I can do to make him look after his property?

We’’ve been having a lot of trouble with a new car we bought, and I would like to know how we go about stopping our direct debit payments.

For two years I’’ve been trying to get something done to stop water from the council’’s storm drain entering my property. The water has weakened the retaining wall in my back yard, but although the council admits that water from the leaking drain is coming into the yard, they say they won’t repair the drain until I’’ve repaired the wall.

My car ran over a broken manhole cover which had become wedged in the opening. The damage was considerable, and we had to pay the excess on our insurance policy, a contribution of £270 towards a new gearbox, plus £150 in car hire charges. We have legal expenses cover but they appear to have drawn a blank on tracing who was responsible for the manhole.

I read that if your vehicle is damaged while on a fee-paying car park, then the owner of the car park has a legal responsibility to make good the damage, even if the car park displays a disclaimer, is this correct?

My son sold his car to a friend for £1600, but after a month he still hadn’’t received the money so he took the car back using a breakdown truck however the friend won’’t hand over the keys, saying he wants paying for four new tyres. My son says it would have cost him more than that to hire a car for a month!

We had some crazy paving done in the back garden, but within a matter of days the cement started to crack and disintegrate. The gardener promised to come back but he now avoids coming to the ‘phone, what can I do?

Building work next door has caused damp to come through into my kitchen and living room. I have asked the neighbour both verbally and in writing to make good the damage but he has made no effort to comply with my requests.
