A building firm is putting up new houses behind us. As a result of the building work our back gardens became flooded with dirty brown water several inches deep on lawns and flower beds. Four weeks ago the builders promised to dig a ditch to stop this happening, but nothing has been done. Can we make them keep their promise?

The incursion of the water into your gardens may amount to a “nuisance” in legal terms, and it’s possible you will be able to put a stop to it, perhaps by means of an injunction if necessary. It’s likely things will progress once the builders are aware you have legal representation, but the solicitor will also look at the possibility of compensation for damage to your gardens and for the inconvenience you have suffered.
