Questions

I am 72 and have about £30,000. When I die I want this money to help my sister, who is 67, and her son and my brother, who are both unwell and live in sheltered accommodation. Would it be sensible to set up a trust? My concern is that the income from it could prevent the beneficiaries from claiming state benefits.

The house we bought was described as having electric wall heaters in four rooms, but we couldn’t test them because the electricity was switched off. They turned out to be a form of air-conditioning, blowing out cold air. If we had known we wouldn’t have bought the house. Do we have a case for compensation from the estate agent?

I received a legacy in my late uncle’s will. However I never saw a copy of the will itself, and my solicitor says I wasn’t entitled to do so because the money “wasn’t paid out of the residue”. What does this mean?

Is there such a thing as a spent conviction? Would an offence resulting in a conditional discharge 30 years ago be regarded as a spent conviction?

A car ran into the back of mine six months ago. I was paid out for the damage to my car, but put in for a whiplash injury. However I’d already been seeing the doctor about a neck pain, and the specialist I saw refuses to say categorically that I’ve sustained a new injury. I’m being sent for a second opinion; do I have to sign to say I agree with the first report?

We were recently transferred to a different company and lost the benefits of a life insurance scheme and profit-related pay. These benefits are still enjoyed by the people who still work for our previous employer – about half the original workforce. Aren’t our previous and present employers breaking the law by doing this?

We have a holiday home, and when we last went there we were shocked to see that our neighbour had inserted two central heating flues through the boundary wall so that they now stick out into our driveway. Are we entitled to remove these ourselves, or can we compel him to move them?

My partner and I were never married and split up two years ago. We have a 14-year-old son, who spends most of his time with me. However his mother undertook responsibility for his health and education and takes him to school. Lately the boy has been playing truant; if the education department decides to prosecute, which of us will end up in court?

There’s a central pillar in the driveway between my house and next door’s, and our garden gates hang from each side of it. Both houses were built at the same time. Which of us is likely to own the pillar, or is it likely to be jointly owned?
