Areas of Law / Insurance law

A coping stone fell from the roof of our council house and damaged my daughter’s car. We claimed on the council’s insurance, and an insurance representative went to see the car at a repair garage. The garage ‘phoned to say they’d been given the go-ahead, but the garage now says the claim has been rejected and they want my daughter to pay the £900 bill.

The dispute is between the garage and the council’s insurers: if at all possible your daughter should keep out of it. If the garage insists that she gave instructions for the work to be done she may have to be prepared to defend a claim in the County Court. Whether the council was responsible for the damage will depend to some extent on the general condition of the roof.
