Areas of Law / Employment

A colleague and I work for a small firm on average three nights a week, but at Easter we had no work for three weeks. Are we entitled to holidays or bank holidays? We don’t get anything at the moment.

All workers are entitled as a minimum to 5.6 weeks paid holiday per annum including public holidays. In your case, you would be paid on the basis of the average number of days you work in a week.  Currently a week’s pay is calculated as an average earned in the previous 12 working weeks. If your employer refuses to give you this paid holiday then you should first raise a formal grievance with them and if that doesn’t work, you can refer the matter to ACAS conciliation and ultimately to an employment tribunal. Act quickly because time limits may apply.
